Pursuant to Law 34/2002, of 11 July, concerning Information Society and Electronic Commerce Services (LSSI CE), MENORCABOATS SLU informs you that it is the owner of the website. As required by Article 10 of this  Law, MENORCABOATS SLU provides the following information: 

User and responsibilities 

Browsing, accessing and using MENORCABOATS SLU’s website confers the status of user. 

The MENORCABOATS SLU website provides a wide range of information, services and data. Users accept  responsibility for using the website correctly. This responsibility will include: 

▪ The truthfulness and lawfulness of the information provided by the user on the forms made available  by MENORCABOATS SLU for accessing certain content or services offered by the website. 

▪ Use of the information, services and data offered by MENORCABOATS SLU in a manner contrary to  these terms and conditions, the Law, morality, good manners or public order, or in any other manner  that may harm third party rights or impair the functioning of the website itself.

MENORCABOATS SLU accepts no liability for the content of websites that can be accessed by the user through  links on its website, provided that it has no effective knowledge that the activity or information to which users  are forwarded or which it recommends is illicit or harms the assets or rights of a third party in a manner that  may entitle to compensation, or, if it does have knowledge, acts with diligence to remove the link or render it  inoperable. 

It will be understood that MENORCABOATS SLU has the effective knowledge referred to in the previous  paragraph when a competent body has declared the unlawfulness of the data, ordered their removal or that  access to them be rendered impossible, or that the existence of the harm had been declared, and  MENORCABOATS SLU knew the corresponding decision, without prejudice to the content detection and  removal procedures that MENORCABOATS SLU may apply by virtue of voluntary agreements and other means  of effective knowledge that may be established. 

MENORCABOATS SLU declares that it has implemented all the necessary measures to prevent any harm to  the users of its website that may arise from browsing the website. Consequently, MENORCABOATS SLU does 

not accept liability, under any circumstance, of any possible harm that the user may suffer as a result of browsing  the Internet. Furthermore, it will not guarantee the technical availability, accuracy, truthfulness, validity or legality  of sites that are not its property that may be accessed by means of the links. 

Changes 

MENORCABOATS SLU reserves the right to make, at any time and without prior notice, modifications and  updates to the information contained on its website or its configuration and presentation. In order to keep the  published information updated, its contents may be modified, corrected, deleted or added at any time, in any  manner admissible by law. 

Indication of prices 

Should prices of products and/or services be shown, those displayed on the screen will be the valid prices in  force at any given time. The prices will be stated in euros and will include Value-Added Tax (VAT). Should the  price not include VAT, this will be stated expressly and the user will be able to view the final full price. 

Likewise, if any other tax may be applicable, this will be stated, including, if applicable, the amount of the  increases or discounts that may be applicable to the price quoted and the additional expenses that may be  passed on to the consumer or user. 

Intellectual and industrial property 

Either in its own right or as licensee, MENORCABOATS SLU holds all the intellectual and industrial property  rights to its website and to the website’s content (including but not limited to images, sound, audio, video,  software or texts; brands or logos, combinations of colours, structure and design, selection of materials used,  computer programmes that are necessary for its functioning, access and use, etc.), owned by  MENORCABOATS SLU. Consequently, they will be works protected as intellectual property under the Spanish  legal system and will be subject to the Spanish and EU regulations in this field, and also to the international  treaties on the matter that have been ratified by Spain.

Users undertake to respect the intellectual and industrial property rights held by MENORCABOATS SLU. Users  may view the portal’s content, and even print, copy and store it on their computer’s hard disc or on any other  physical medium, provided that it is solely for their personal and private use. Users must refrain from overriding,  tampering with, bypassing or manipulating any protective device or security system that may be installed on  MENORCABOATS SLU’s website.

The SSL CERTIFICATE provides authentication, privacy and security of information between  MENORCABOATS SLU and the user.

Legal actions, applicable law and jurisdiction

MENORCABOATS SLU reserves the right to bring any civil or criminal actions that they deem appropriate for  improper use of their website and content, or for non-fulfilment of these terms. 

The relationship between user and provider will be governed by the regulations in force and applicable in Spain.  In the event of any disagreement between the parties, they may submit their conflicts for arbitration or take them  to the ordinary courts, in accordance with the applicable rules concerning jurisdiction 

Contracts concluded electronically to which a consumer is a party are considered to have been concluded in  the place where the consumer has his habitual residence. 

Electronic contracts between entrepreneurs or professionals, in the absence of an agreement between the  parties, are considered to have been concluded in the place where the service provider is established.
